I ordered a bouquet of flowers to be delivered to a friend from an online seller.

Initial delivery unsuccessful which led to the post office to leave them with no water over bank holiday weekend meaning my mate had to go to post office to collect dead flowers. Company good enough to rearrange delivery however, no flowers arrived.

The company state delivery was attempted unsuccessfully and not picked up from post office after this. My friend assures me she had no notification of a failed delivery but the company are refusing to refund me my money!

Do I have any rights to a refund? It seems awfully unfair.

Its not the retailers fault that there was no-one there to collect.

There was no opportunity for my friend to collect her flowers after this alleged failed deliver. That would not have been a problem. They claim there was an attempt to deliver & an unable to deliver card left- no such card was ever posted to my friend or she would have collected them, like she did the dead ones!

How did she know to go and collect the flowers dead or alive?
  • She collected the dead ones after a card was left. The company then arranged to deliver some further flowers to replace the dead one and no card was left for those.

I'd ask for evidence that a delivery was attempted. If they refuse I don't think that there's much you can do though.

But the OP said that a card wasn't left no such card was ever posted to my friend or she would have collected them, like she did the dead ones!

If the friend wasn't there for the first lot of flowers and didn't make arrangements to collect them quickly you can hardly blame the flower company and expect a refund.
  • It's not complicated!

OP ordered some flowers for friend
Attempted delivery made & card left
OP friend went to pick up flowers which were dead by that stage
OP contacted flower providers re dead flowers & they agreed to send some more
OP friend did not receive any flowers so OP contacted flower provider
Flower provider advised that delivery had been attempted and flowers never picked up
OP friend never received notice of delivery re 2nd flowers and therefore could not pick them up

I think that you were lucky that they agreed to send a 2nd lot in the first place so I don't think you'll get very far I'm afraid
