can i claim or not

sorry i know the answer is there some where but im new desperate and this might help me sleep!
since the court ruling i thought i couldnt claim.. but then i just read something about it not affecting financial hardship cases???
is this true.. if so can i claim .. i have a court hearing early jan for possesion of my property due to mortgage arrears.. i have about £4k worth of charges to claim back from lloyds... and it could seriously help me with the mortgage arrears!!!!

December £35,000
includes: £10k mortgage arrears, £4k credit cards £4k loan, £15k 2 cars HP. £2K store cards, utilities, family!

Have you spoken to your bank about the fact you are suffering financial hardship and what help they can give to you?0 -

A. The FSA's hold on banks dealing with the reclaim has been lifted, so there is no longer a specific hardship rule.
However, under FSA regulations, banks must treat you fairly anyway and be considerate if you are in hardship. If you think that hasn't happened you can complain to the Ombudsman (see How to complain to the Ombudsman guide). Though if it's about bank charges specifically it's best to follow the information below.
