Faulty laptop - need some help

Options
Hi,

i bought a lap top from Selfridges and now they are refusing to exchange and only will send of the manufacture to get a repair cost, this they said they woud do 1 week after i informed them of the problem.

the laptop after doing some research suffers with this problem and is common so maybe they were selling bad products?

the lap top was bought in early May 2008

Can i just insist on a replacement after all spending £800 on a lap top you expect it to last more than this!

thanks momo1975

No you can't insist on a replacement. The retailer are well within their rights to attempt to repair the laptop.

Only then may they offer a replacement or partial refund.

And what do you mean by research? Several people on the internet having the same problem isn't evidence of a problem being "common".

But a repair would be an adequate solution.

How long was the warranty for? You've had it about a year and a half. As you have had it so long its actually down to you to prove the fault was inherent and not caused by you in order to get any remedy at all. If it's out of warranty and depending on what the problem actually is, they may well want you to pay for the repair.

If they do take responsibility for the fault, then they are WELL within their rights to have the laptop repaired, and you should be glad its getting repaired free of charge. Its totally unreasonable for you to try and insist on a refund or replacement and the law isn't on your side either.
  • As the others have said, Selfridges are entirely within their rights. If the laptop was less than say a month old, then you'd be on better grounds to insist away but your laptop is 19mths old. The £800 price tag hardly makes it a Rolls Royce Gold Plated one at that.
  • Just reiterating what others have said really.

There's an act covering you here, so don't worry about whether it's repaired or replaced. Basically, warranty aside, if the laptop doesn't last as long as a reasonable consumer expects it to, taking into account the price, type of item, usage etc. you are entitled to have it repaired/replaced etc.

However, you do not get to choose which of these it is. If the seller wishes to try and repair it, you have to swallow it I'm afraid. If it kept breaking after multiple repairs (which happened to my boyfriend's superoverheating laptop) then you can push for an exchange. In his case though, he actually filmed the laptop overheating and shutting off to disprove their arguments of him misusing it before they finally caved.

So, in a nutshell, let them repair it. If it breaks again a few months down the line, they can reassess the situation and you have more of a chance of an exchange. If there's no problem, even better.
