jsa after mat allowance?

Hi

I am due to come to the end of my maternity leave at the end of December.

I was previously self employed on a contract which I presumed I would be going back to, I have just (last week) found out this is not the case.

I have been searching for a job and cant find much, the things I have applied for may come through but Im just wondering if there is any chance of jsa to cover me for a short time.

A friend told me I could get jsa as I have had my stamp paid due to child benefit ....
I dont have enough NI contributions due to being self employed, I cant claim income based as my OH earns over.

Anyone any experience of this?

    Hiya and congratulations on the new baby.

    Were you self employed or did you pay on a PAYE basis? If it was the latter and you have 2 years of contributions then you will have enough to claim contributions based JSA, if not it will be income based that you have stated you are unlikely to get.

    Your CB pays home responsibility NI contributions which shortens the number of years NI you need to put in to claim a state pension, it does not pay NI contributions which can be used towards any other form of benefit unfortunately.

    Even if you do not qualify for IB JSA you should still sign on as there will be training courses and help available further down the line that you may miss out on if you cannot find work in the short term.

    I thought that was the case to be honest, I just wanted to confirm before panic stations set in! :o
    I wasnt on paye so no chance at all as OH earns a fairly decent wage well above national average.

    bit confused on how you are self employed, but the company you are contracting for, has said there is no contract for you to come back to

    if you really are self employed, how was cover provided whilst you were on mat leave?

    Sorry if I confused you :confused: I wasnt the only person doing my job ..... they didnt need an actual body to cover my maternity leave. I am certainly really self employed and have been for a few years.
    I pay my tax and NI. Im unsure why you are questioning me?

    I think the fact here is that you cant decide if you are "self-employed" only HMRC can.

    namely the fact they have said there is no work for you to come back to, to me means you are employed

    if you were self-employed, you would have some say in the matter - ie you would have been required to provide cover for your absence, your mat leave would have no bearing on whether there was work available or not, and as you are in control of the contract, it can only be terminated with your agreement

    Unless you alone dictate the hours, time, staff cover, and place of work, then you are not self-employed

    I didnt say there was no work for me to go back to. I just said, I found out I wouldnt be going back. Reasons I dont need to go into, but it has nothing to do with the volume of work they have. :o

    from your first post you intimated that is was the company you work for, who was stopping you from returning - whether the reasons were workload based or not, you infer that they are the ones terminating the contract, as you were all ready to return to working for them

    as you state, due to your lack of NICs, and your OHs income, you wont be entitled to JSA - CB only gives you basic NI cover whilst not working, and if on mat leave, then you are classed as being employed, so the CB cover doesnt kick in (but then again, it still wouldnt be the 2yrs you need for CBJSA)

    Have you been claiming MA, whilst on mat leave?
