actually i cant speak for all providers, but the network i used to work for, we were told if the person who holds the contract cant get them back off the person who uses them, and has told them to hand them over then we were happy to accept a theft report; as effectively thats what we classed it as. You need a crime number though, so it becomes a police matter. But ultimately, when they're your property... and it may teach her a lesson.On the up

The network will only cut off the sim and provide a new sim to your address. The amount would still need to be paid. Would stop her getting any use out of it.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

Here is a full list of what is owed and where it came from. How do you want to arrange to pay it back and also for the phone?
LIST OF DEBTS
I would recommend £250 per month starting 28th January 2010, for 6 months, plus the phone bill whatever this may be. You would be able to go into the bank and request to set up a Standing Order for lets say £300, until it is paid. This would mean the following payments:
January 28th - £250 + Phone bill amount
February 28th - £250 + Phone bill amount
March 28th - £250 + Phone bill amount
April 28th - £250 + Phone bill amount
May 28th - £250 + Phone bill amount
June 28th - £143.36 + Phone bill amount
If you feel this is a little unrealistic please let me know, and we can arrange some other amount of payment. If you would rather you could drop off the money with someone each month on a specific date, and I can pick it up from there. That way we don’t have to have contact if you would prefer.
Is this something you would be willing to accept?

I know I have been offering advice but look at what your asking her and put yourself in her shoes.
Your asking for more than half her income if she has a parttime job and income support. Is that realistic, she needs to pay it back but if you want any money at all it needs to be plausible otherwise she will get all defensive again. Total up what she owes, how much she needs to pay each month for the ongoing bills and then ask her what she feels she can pay over and above that.
If the boot was on the other foot and it was you being asked for money by a creditor would you find is possible, yes i know you wouldn't have gotten to that stage and so on. Just try a little devils advocate here, in the long run it makes payments seem more possible than none at all.New PV club member. 3.99kW system. (I get that she could work and earn money, but is she actually working at the moment, or is she just on JSA?)I'm a retired employment solicitor. So she is not in receipt of benefits, and she has no job?
I think you have to be realistic here - if she has no income then she doesn't have the money to pay you back. £250 a month, or £150 a month, it makes no difference if that is more than she is earning.
If she signs on, I'd suggest £50 a month is reasonable if she is living with family and has few overheads. But you should be aware that, if you go to court and win, provided she can produce an SOA to show that she can't afford to pay you, then the court is likely to order her to pay a token payment of £1 a month.I'm a retired employment solicitor. shes just being lazy... as long as she doesnt have a job she doesnt have to pay anything back.
