Hello all. We have followed the procedure for claiming back charges on this site. After sending off all of the infomation to the FOS, it had been over 8 weeks since the initial complaint, we received a reply from them stating that they cannot deal with it as Cap1 have provided an opening for a reply, therefore the complaints procedure is not exhausted...
We had also not received a 'final response' so the FOS said that they would contact Cap1 to try and get one for us. The FOS also stated that a complaint starts from the last letter that was sent, which seems to ignore the 8 weeks that they state on their complaint form.
Basically, the opening that Cap1 provided was only for us to sign their acceptance of the offfer. There was no other opening for debate. As of today they have not provided a 'final response', but have while the account has been in dispute issued a default and let fpc (Fredrickson International Limited) to attempt enforcement.
We sent both Cap1 and fpc letters this week requesting a 'final response' and informing them of their OFT breach with regard to disputed debts. Any further advice would be greatfully received?
