    Hi all,
Not sure if im right in doing this but im claiming from GMAC and writing directly to the financial ombudsman am i better going direct to them rather than gmac? looking at all your comments i want sure whether i was doing the right thing but i just want t fast track and make sure im not messed about

You need to follow the correct processes. There is not fast track way so you dont get messed around.
  • what if the dealer no longer exists? surely the finance company is liable, as GMACUK cover a lot of dealerships?

Old thread but no. The dealer is liable. Occasionally they may have been a Representative of another firm who will be.

The post by PaulinWeston are incorrect.
  • So in the instance where the dealer is no longer around due to closure.... Where or who do we pursue?
    It is all lost?

Certainly if the sale of the insurance was prior to 2005 then there is no recourse and your complaint is over before it begins.

For cases 2005 onwards where the dealer is no longer trading then FSCS can provide some of the redress.

If sold post 14 Jan 2005 then contact the FSCS.
    It is all lost?
If pre 14 Jan 2005 then yes.

    Thanks all.
Looks like I have to go via Fscs

    You mentioned 2005
If I took out an original loan in 2002 that was then topped up in 2004 running to 2007 then topped up again, but paid off in 2009

Is there no redress for the first loan, but maybe for the second and third?
Or would it be no, as original was in 2002...?
    Thanks in advance

The FSCS will only look at those bough after January 2005.
