Seller hasnt refunded on ebay

1 bought 3 pairs of kids shoes on 21 nov and paid same day by postal order.seller confirmed receipt of payment and said items would be posted.i noticed on details they were marked as posted on 25 nov.they never arrived but was allowing for busy christmas post so didnt ask,.i tehn had message stating they would post on 4th dec.i then received a message from seller on 5th dec saying have you got the shoes(this is exactly their words).i replied no,but if you only posted them yesterday it was unlikely.they said they hadnt posted them and she has lost them and would i like some other nice boots in size 7(again exact wording).no thanks i said,just the ones i bought or a refund is fine.tried to convince me again to have some other lovely shoes but requested refund.she said she posted refund to me on 7th.not received it,i contacted her this evening and she says ,she should have got proof of postage as she knew i would say i hadnt got the postal order and she cant help me anymore as she is out of pocket.i have not made her out of pocket i have no shoes and lost £22.have reported item not received and her response is sent postal order back to buyer and have proof.where do i stand,what can i do as i didnt use paypal.any suggestions?

    BTW its only 4 days since the 7th and we are in the xmas month
    you can start a dispute in ebay though ive never done a non PP one so someone will have to advise

    Sadly, I think you are not going to get your money back from eBay as you didn't pay via PayPal. This is why most of us (if not all) pay with PayPal as buyers, because if an item is not received (unless the seller can *prove* delivery) you will get a refund.

    It's always hard in these situations, when you have to decide if you can believe someone. I'm inclined to think she is lying, but I am a pessimist after about 10 years on eBay as both a buyer and a seller. I always send out items recorded, even though it costs more so that I can 'prove' I sent it. As yet (touch wood) I have not had a parcel not arrive. I have had several items I have bought not arrive, usually when I have won something for a lot less than it probably should have gone for, so because it's only on those occasions (and the sellers went on and on and on....too much detail is usually a sign of deception) that my stuff didn't arrive, I chose to think they were telling lies.

    My gut tells me this seller took advantage of someone who trusted them with a postal order. Had you bought from me and most of the people on this board, you would have got a refund had they not arrived, but we would have posted them in the first place!

    Maybe I'm being unfair, i'll see what others think. I feel for you. £22 is a lot to lose at Christmas or any time of year.

    Can you open a PayPal account for next time? Best not to send postal orders, it really isn't. Not everyone is honest on eBay sadly. Protect yourself and you will enjoy it and find bargains.

    Sounds like a horrid seller. A right unprofessional chancer, trying to put guilt on you for her mistakes.
    Appeal to her better nature as nicely as you can and if you get nowhere leave her a nice big fat red neg on her Ebay feedback.

  • thanks for your replies.i do actually have a paypal account but hadnt sold anything for a long while and didnt have enough funds in it.the card i had linked has since expired and i thought to transfer money from bank would be slow,although couldnt have been any slower than the mentioned sale.i dont want to leave any feedback just yet,thought id better wait just incase my refund does turn up,but wont hold my breath.was buying the shoes as the kids have a christmas party tomorrow and wanted them to look their best,so mad at myself as ive never used a postal order before and never will again.lesson learnt for me.

    I'm sure I read somewhere that in some cases like this, ebay are refunding themselves then chasing up the seller to get their money back. You could try opening a dispute in the drop down box you will have next to the listing in your 'my ebay'. I think the option is 'resolve a problem'.

    They didn't in a case I had a few months ago. I didn't receive an item, contacted seller etc etc with no joy. I went to open a dispute and it wouldn't let me and gave a number to call instead. In the end ebay gave me the refund and said they would chase the seller themselves.

    In this case I did pay by Paypal, but I'm sure I've heard of buyers paying my cheque or postal order and ebay refunding as a goodwill gesture.
