Lodger Tenancy Agreement

Are you certain your brother can't claim any benefits? I am no expert but, whilst the powers-that-be would not expect you to charge rent, they *may* be happy to accept that he is contributing to the council tax/ utilities/ his own food, especially if you have a formal lodger agreement??
No, I've been over it. Apparently I have no financial obligation to look after my brother, but if he lives in my house he can't claim any costs of housing back. He can claim JSA, but nothing for rent. I would be much better off kicking him out and getting in a paying lodger, and letting the state pay for him to live instead. As it is, currently my mortgage overpayments will be zero because it was money I was expecting from him.
I could have had him move out, and room swapped with a friend, thereby allowing him to claim housing benefits and still getting rent myself. I have decided against this for now, but if I get too skint he'll have to go. We've rented together for 5 years now, so its not like I've set this place up just to gain benefits (although he's only been out of work recently). The gov wont give money to a family member though.0
