Fos has refused to uphold my complaint
Hello everyone
A little background to my story:
I took out a loan from my bank to pay off the previous loan and then use the balance.
PPI had been applied to my previous loan which I was not aware of.
The PPI on the previous loan was paid back.
I requested for copies of all my loan agreements which my bank failed to provide.
The back said my 1st loan back in 2000 was too old to retrieve the agreement.
The second agreement the bank said I had PPI applied to it and this was refunded. I was made to believe that the amount was what they said but did not provide me with a copy of the agreement.
The 3rd (current) loan, the bank said they could not find the agreement. They said no PPI was applied to this loan.
I requested for an executed copy of current loan agreement. The bank insisted that they could not provide.
I notified my bank that I would not make further payments if they did not provide me with an executed copy of the agreement.
I had a final letter from the bank. I then complained to the FOS.
I had a response from FOS a couple of days ago. FOS said that it's clear I took out the Loan I therefore should repay the loan.
FOS also stated that the bank is not prevented from seeking repayments of the debt.
The bank has suspended my account. I cannot use the card or access my current account online. I believe this is wrong as there is a dispute.
What do I do next? Your advice will be much appreciated

Yes, it is absolutely outrageous of the banks to expect people to pay back the money they have borrowed.I used to think that good grammar is important, but now I know that good wine is importanter.0 -

The only dispute in this case is currently being dealt with under Mosdee v Reality (2009).....( my money is on Reality BTW)What do I do next? Your advice will be much appreciated

To be honest OP the FOS will always side with the banks in situations like this. They aren't as much interested in applying the letter of the law (which is as clear as mud at the moment anyway) as in upholding what they believe to be fair and reasonable.
I'm afraid that there isn't a lot you can do about this, other than pay the loans or seek help from one of the debt organisations like the CCCS if you really can't afford to pay.0 -
