cancelling dfs order

Hi,
I was on the verge of buying my first new house so ordered a new suite from DFS. I was told that they had a `first time buyers` policy which allowed you to cancell the order if your house deal fell through. With one week to go before I was due to get the keys for my new home the seller of the house pulled out of the deal, leaving both me and my partner absolutely devastated. We have still to pay the solicitor and now to make things worse, DFS have gone back on their `first time buyer` promise and said I must take delivery of the suite. I haven`t payed them anything yet as this was a buy now pay later deal. I haven`t taken delivery of the suite either. I suggested they store the suite until I found a new house but they say they don`t have storage space!!
They are getting quite aggresive in there attempts to get me to take delivery of the suite. Can anybody please offer me any advice on what to do.

    Who told you this, did you DFS confirm this when you ordered? If this offer did exist what were there reasons for going back on it?
  • I was told by the salesman at the time of ordering. I don`t know why they have gone back on their word. They rang me to ask about a delivery date, at that time it was the 8th Dec. They said they would deliver on the 9th. I agreed. Three days later I got the news of the house falling through. I immediately rang DFS and they said because I had given them a delivery date, which they requested, the first time buyer deal didn`t count. I don`t know under which circumstances the first time buyer promise would count.

    Why not ask them. You need to find out if this was a "real" offer or not, or whether the salesman was simply lying to you. If it was a genuine offer then ask for a proper explanation as to why they're refusing to honour it.

    Actually reading your post again, it makes perfect sense. The deal is you can order the sofa without a delivery date because you don't know when your completion date will be and until you confirm this you can cancel at any time. At the point you do confirm a delivery date, because you've now got a date for completion, you can no longer cancel. This sounds fair enough, it's not DFS's fault that your buyer pulled out, maybe you should have waited until you completed first before confirming a delivery date.
