    It doesn't matter whose bank account the money was paid into as 2 people had to sign the original application form. The Tax Credit Office rightly assume that being adults both applicants agreed between themselves whose account the tax credits were to be paid into and so both are jointly liable for any overpayment on the claim.

    Are you also bankrupt?

    And can tax credit overpayments be included in your DHs bancruptcy when you were also on the claim and you are not bankrupt, I thought that couples are jointly liable.

    May not be relevant to this situation but normal joint debts aren't included in the bankruptcy of one of the people; they remain the responsibility of the other person.

    They'll catch you at some point so you might as well start paying now; will your husband be getting a job soon?
