Child Tax Credit Help Needed

Hi everyone, I am looking for some advice from you.

2 of my good friends split up back in April, late August this year the eldest son moved out of his mum's home and into his dad's on her suggestion. (They do have 2 other children together who remain with the mum)

The dad has been trying to claim tax credit's for the child that now lives with him and has been trying for a few months now. Tax credits were saying that they needed to investigate the claim as 2 people were now trying to claim for the same child.

They wrote to the mum and asked her who the child lived with, who the school, docs was registered with. Who bought his last toothbrush etc. The mother has said that the child still lives with her and everything is under her address and she bought his last everything basically as 1 she wants the money and 2 she would like the child to come back despite him not wanting to.

Today the dad has been advised that he will not be awarded the money for the child and all monies will stay with the mum.

How can this be correct when the child does live with the dad, his docs and school is registered at his dad's address, all his clothes etc are at his dad's.

I really don't agree with this decision but am at a lost of what to suggest. His solicitors sent in letters to support his application, the school have written a letter.

I would really like to help the dad as I feel it is the child that is losing out here and that is who should come first.

    Appeal the decision, as a matter of interest who gets the child benefit then?

  • Appeal the decision providing evidence with the appeal. A letter from the doctor and school may help.

    Ideally a legal letter (cout order/custody agrement) regarding responsibility would be of most help.

    Don't just re-apply as the backdating would not be as much as what it would be if he appealed. From memory, I think he must appeal within 30 days of receiving the outcome of the application.

    The mum gets the child benefit, she won't give that up either. He is also fighting for that!!
