Need Advice

In quite a lot of debt, I kept having loads and loads of calls fom Various companys claiming I owed this that and the other, the problem is that I could not keep up with all of these as the companys kept debts kept changing hands, Yesterday I received an email from Bob at 1st Credit saying that I had put information about 1st Credit on an email that was false and I was to appoligise on the forum, I did put down info but it was not false, (THIS BOB BLOKE IS DENIEING EVERYTHING) email below
I just am at a lost as I am really worried on what to do now as the company still keep ringing and ringing :confused:

Firstly my apologies for our failure to reply to your earlier communication.

We take complaints against our company seriously and we are very happy to look into this. We note that you stated on a public forum;

a) One of our staff stated that the matter was, ‘an emergency’.

We can find no record of our staff having a lengthy call with you. Notes suggest that on being connected you yourself terminated the call. Do you have the date and time of this specific call? We would then be able to search our records and listen to the actual call.
In addition, (see below), was it definitely 1st Credit? We outsourced this account to a third party when we failed to obtain a response to our letters/calls and it is possible it was this company, not ourselves?

b) That we call over 6 times per day during the week and at weekends.

This is impossible. Our automated dialler cannot do this. I have checked dialler records and it shows the following calls were made. 8 times in 10 months.

You may note that no calls at all were made between March to November. The account had been outsourced during this period.
We are able to obtain a statement from our dialler company to substantiate that the statement you have made is completely false. (IT IS NOT FALSE)We trust therefore that you will amend your post or put a disclaimer on this forum confirming that your original statement was incorrect. If you are being called numerous times it is not 1st Credit calling you.
Individuals requesting a ‘True Copy’ of their credit agreement are obliged to make a payment of £1.00. We have not received this payment and therefore are not obliged to provide a copy until you do so. However, as a gesture of goodwill I have requested a copy for you.

Please e.mail me or telephone me should you wish to discuss the matter. Please be assured that I am rather a polite individual and you would be spoken to courteously in respect of this matter.

    I love the last line... "I am rather a polite individual" - apart from the fact there must be hundreds of people on here who can testify to the opposite about 1st credits staff in general (I can make no judgement on Mr Kingdon) then I would assume that ANY professional person employed by 1st should surely be polite and speak curteously and so there shouldn't be a need to point out that Bob is special? :confused: or is he the ONLY polite person there in which case I think maybe they want to look at retraining their entire staff - with the exception of our delightfully polite Bob ;)

    So they can find no evidence of a lenghty call - but the lengthy call was according to their noted terminated by them? But it never happened did it Bob??? ;)
    Outsourcing chasing people makes not a blind bit of difference - if they have instructed a 3rd party to make the calls then they should have full access to the data held by this company - Bob as you seem to read this forum you might want to read through the Data Protection Act of 1988... you may find it interesting especially the part about owning and holding data etc...

    But Bob darling - you outsourced it... and you apparently can't locate the records without the client providing you with date and times - which tells me that you can't locate records accurately by phone number... so how do you know?

    Again Bob my dear... if you can't trace calls through your 3rd party by number (if you could then the first point is a lie as you don't need times and dates to trace the call) then how can you prove this? and it doesn't have to be you calling - if you have instructed another agent or outsource company to do this for you then YOU remain responcible for their actions. And therefor you should be able to produce a list of the exact times and dates of any calls made to the OP - not the other way round... And that includes any auto dialler calles that did not result in a connection to an agent... because the server that runs that will have a complete list of what numbers it has rung and when... infact data that can be investigated by the Ombudsman if need be... :)

    I think this thread should be entitled 'send a message to Bob - the polite individual'

    Bob - how are you getting on with meeting the requirements made by the OFT earlier this year?

    In particular, what changes have you made to:

    •refrain from issuing statutory demands warning of bankruptcy where it is unlikely that proceedings will be initiated
    •not discuss legal action with consumers unless it is likely that such action will be taken
    •ensure that sensitive cases involving vulnerable individuals, for example those with mental health or medical problems, are dealt with appropriately, and
    •ensure that all matters of concern raised with them by the free advice sector and other third parties are dealt with appropriately.
