CC reclaiming letter to go to Solicitor or MBNA

Hi all,

Please can anyone advise.
My OH has a CCJ against him from Alliance&Leicester/MBNA for his credit card.
They didnt wait for our DMP to start and took him to Northampton Court. (he didnt need to attend)
Judge ruled in his favour and said that he needs to continue paying £3 a month until the debt clears. (14K debt which was originally 9K but all the charges in the last year and half have pushed it up to 14K)
MBNA werent happy with this so have gone for a redetermination which will now be in Feb 2010.
In the meantime he is paying the £3 monthly and the payments have been going to Restons Solicitors as instructed by the court.

My question is this : I have been going over his cc statements and have found charges totalling almost £500. (late payment/over limit) and would like to see if he can get that taken off his debt.

Should I send the letter to Restons or MBNA?

Debt Free in 13 Years 1 month, hopefully sooner as things improve and they stop interest/charges!!

  • MBNA. I would ask MBNA for copies of ALL statements since the account was opened and claim the lot PLUS interest.

    Do I need to send a cheque for £10 with the first letter?
    Also, as far as I understand he can only claim for over the limit fees and late payment fees (some months they charged him twice) so when you say 'claim the lot' you mean since 1995? The statements we have go back 7 years.

    I have read and reread the section on reclaiming.......do I need to specify the half of £35 refund or just go for the lot and see what they say?

    Last one....the first letter to send out in the CC reclaiming section requests for information going back 6 years only. Is it ok to go back to 1995? I'm just adjusting the template letter now and not sure what to put.

  • You claim the lot and ask for more statements including £10 fee.
