repayment of tax credits

Have i got this right, that if an over payment is made , that if it their fault, ie a computer error, do you not have to repay the amount?
They have overpaid me £38, not a large sum, but i am damned if i should pick up the bill for their incompetance.

Sorry to bust your bubble but you do have to repay this overpayment. If you are still receiving an award they will reduce the new one by the amount you 'owe'.
We were overpaid a few hundred pounds one year when my husband had been made redundant and then got a new job (which started off low paid), I knew we would have to repay it the following year but we were so skint that the overpaid award was the only thing helping to keep our finances afloat.
I'm sure we had a reduced Tax Credit award to 'catch up' after that.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Well, if you dispute the overpayment (with a COP26 form) and it comes back as an NTC error (computer or human) then you do not need to pay the overpayment back - and anything that has been taken off your current (or previous awards) for that overpayment will be paid back to you.
If, however, you fail to declare any changes of circumstances or give wrong/false information, you'll have to pay it back in full.Don't mention it... just buy me a pint!

I think if you know it's an overpayment, i.e. they send you an award notice that is clearly wrong, then you are still liable to pay them back.0

I received an overpayment of some £500 due to their mistake. they originally said I had to pay it back, however I then contacted them and stated that:
1) I supplied them with all the correct information in a timely manner, and
2) Repayment would cause some hardship, even over time.
It took them months to get back to me but I eventually received a letter from them stating that as the overpayment was not my fault, but theirs then they would not recoup it.

I got overpaid by £45 a month ago, they send me a letter asking for it back and I sent them a cheque, I rather pay them back now then them re-claim it at the end of the tax year0
