Transfer of Title Deeds in Scotland

My partner bought his mothers council house for her around 7 years ago so that she wouldn't have to pay rent. We are looking to put an extension onto our house and having explored mortgage options have decided that it would be best to borrow on this property as his mother has no intentions of moving so it would mean that we could be more flexible with our property. The property is in his mothers name and she is not earning so the property would have to be changed to my partners name in order for us to take a mortgage.
Can anyone tell me how long/much/easy this would be?

  • i've never transferred title deeds, only gotten deeds back from the mortgage provider, but you will have to use a solicitor to carry out the legal work here. depending on their rates this could cost anything from £200 - £600, based on a quick google search of other people posting about similar things. i'd suggest you contact a solicitor about the matter asap.
  • Thanks my partner contacted a solicitor who we have used in the past and was quoted £800 - think I'll phone another few and try to get a better price.

    I purchased a property, cash, from one of my daughters at a knock down price, no problems at all.
    The agreed price was just enough to clear her outstanding mortgage & I now have a property worth at least double what I paid.
    I could have taken out a mortgage but thought that this was a safer place to stash some money.
    A. & L. & solicitors were all O.K..
    Just go ahead & do it before circumstances change, any problems can be sorted out later.

    Can I ask did you get the property changed into your name and if so was there much involved in doing so?
