parking fine - 2 problems

First one

Parking fine states Cumberland St from 10-51 to 10-52 yesterday morning.

The car never moved from Westmorland St yesterday at all.

Cumberland St is the next road over but runs parrelel to our road.

Cumbria County Council who are the lead authority regarding the implementation of the resident's parking scheme, are considering changes to the process of issuing resident's parking permits.
To enable this process and any subsequent considerations to take place there will be no annual renewal of permits until further notice.
Please continue to use your resident's and visitor permits in the normal way.
The Civil Enforcement Officers have been instructed to honour the permits residents currently have on display, expired or not. Please note regulations about having to display a permit or disc in the restricted zones have not changed.
We can only apologise for this situation but as soon as further direction is available from the County Council all residents will be contacted.
For any updates,discussions or comments regarding the changes to the resident's parking scheme please contact the County Council.

My OH has been displaying the temporary green residents pass for the past 2 months due to the quote above. I have told him to put his proper residents pass up (cos we do have one for the car) but you know what men are like!

When I got the green pass, I was told by council woman that all cars in zone D (where I live) would not be getting any parking fines due to the council not sorting out the parking scheme yet and as long as we have displayed a pass for the zone D area it didnt matter that it was expired or not, we would not get a parking fine.

The local traffic wardens are very HOT in this area.

So ... do we have a case to appeal or should we just cough up the £ 25-00 ?

  • 1st one appeal that the contravention did not take place. (the car was never in Cumberland street)
    2nd one is unclear what the contravention is, more details please, copy of both sides pcn would help, remove personal details.

    2nd one - we should not have got a parking ticket anyway due to showing a zone D area pass albeit one that had expired and was a temporary one anyway
