MBNA PPI reclaim question

I recently discovered that the PPI that I have been paying on my MBNA credit card that I took out in 1999 was optional. I have written to MBNA explaining this and they wrote back advising that I took out this policy after a phone call from one of their salespeople shortly after opening the account.
I have no recollection whatsoever of this call, if they had phoned up and tried to sell me it, I would have declined as I was in my early 20's at the time, got sickpay from my employer and wouldn't pay for something I didn't need.
I wrote back explaining this and I'm still waiting to hear back from them. Is the onus on them to prove it wasn't missold, or on me to prove it was? Obviously I don't record my phone calls, it is really a case of their word against mine?
Can anyone offer any advice on this?
Cheers
Dave

Hi Dave
I would ask them to supply the evidence to you, if they told you this, they are bound to have the details on this, ask them to provide them to you, otherwise it could just be a fob off.
If this does not end up going in your favour it is still worthwhile requesting that the Financial ombudsman service (FOS) to investigate this for you.
Due to your reasons anyway, I think due to this you have a good chance.;)The one and only "Dizzy Di"
