unpaid invoices

hi there In april i did some work for a company who said they would pay me every 2 weeks after the 2 weeks i hadnt been payed anything so i stopped working for them because i said ive give you to much credit,(£3500)looked on companies house and they had set up another company a few days before my last job.They keep tellin me they are goin to pay me from the new company,the old company is still on companies house site and was only set up the start of the year,have they done anything illegal?

    They can open as many companies as they want, but I think you would have difficulty in getting money out of the second company if the contract was with the first company. Why havn't you taken them to the Small Claims Court by now?

    Chances are they are going to transfer the assets to the new company, leaving the old company holding the liabilities (including your money). Whilst immoral this is actually quite legal :mad:

    Some folk will recommend issuing for the cash yourself in small claims, however you need to do something ASAP. In this instance i'd use a no collection no fee commercial recovery agent to chase your invoices.

    I would use a no fee collection agency or take them to the small claims court. In future, why not ask for 50% deposit up front - lots of businesses do that and make the deposit non-refundable because if customers start messing about then you still have 50% of the money.
