Small Claims (County) Court

I want to take Easyjet through the small claims court. My experience with Easyjet in trying to resolve a dispute is that they use spoiling tactics non stop and hope that you give up in frustration!!
My question is that if I issue proceedings to take place in Plymouth can Easyjet apply to have the hearing transferred to Luton. This then makes it uneconomical to travel and stay overnight, and then if judge adjourns/delays/is running late etc............
Answers eagerly awaited!

    Trying to resolve a dispute with Easyjet is near impossible, as their customer service staff are complete morons, and you'll never get any common sense. I sympathise.

    They can move the hearing to Luton if they want, but if you win, they pay your costs.
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    I had read on Court guidance website "that if you as the defendant are an individual and the claim is less than £5000, you can move the hearing to your local court"
    I had read that to mean that a corporate body could not move the hearing? But then I wasn't sure that a corporate body would be reading the guidance note and therefore didn't have to be told!!

    I would say that if your not prepared to travel if required then you obviously don't take the court action seriously enough, so don't bother with it. I think EasyJet could ask for the hearing to be conducted local to them but you can object if it would make it very hard for you to get there, but don't know whether your objection would be successful or not as depends on circumstances.
  • no I do take the court action seriously enough, but I am only talking £700. It would be a 700 mile round trip plus overnight stay. Couple that with Easyjet coming up with reason to put case back on the day, I am then faced with 2 round trips and 2 hotels. It is a case of balancing cost versus outcome.
    I can of course put in a very comprehensive case in writing. It is based on fact and not open to vagueness, but I would rather be there.
