PC Graphics Card Warranty question..... Scan Computing

Hi all.
I have a question about warranty for PC components.
My (pretty expensive) graphics card failed at 11 months after purchase from Scan Computing, it has a 3 year warranty from Asus, but Asus don’t deal with warranty repairs/refunds/replacements, instead referring you to the vendor.
Both my PC engineer and Scan have tested and agreed that the card is faulty. I’m now in negotiations with Scan for a replacement.
My expectation of a warranty replacement is that Scan (or Asus) should replace my card with a similarly specced new card. Obviously in the intervening 11 months, the card is no longer made (it’s a 280GTX model). The only suitably specced model is a newer 285GTX. Scan, however, are saying that the value of any replacement card will take into account useage and value gained from the original card over the time I’ve owned it.
So, if Scan value my card at £X for refund/replacement, and the cost of a like for like replacement (or as near as is possible) is £Y, where do I stand? What are my rights? Has anyone experienced Scan or have any thoughts on how to go forward with them? I’ve had two or three bad experiences with them with components all bought at the same time from them. I’ll never deal with them again, people at their returns department have been pretty unpleasant to me in the past.

Have you tried talking to ASUS and seeing what they offer?
I think you will have a warranty claim against ASUS and a Sale of Goods Act claim against Scan either of which you could enforce (your choice), not sure what precidents/small print will apply in either case about allowing mark downs for 'useage' of their faulty producct. I'd suggest double checking your rights on both counts and going down the route that gets you the most recompense for the least hassle.....0 -
As Jasx mentions, quote the Sale of Goods Act. I think they can offer an alternative - BUT you have to agree, which obviously you don't (and won't).0

If it's scan in Bolton you may face an uphill struggle with replacement...
I haven't used them in years due to their returns policy :mad:
Frankly i would want a card of an equal spec or a card worth the same as the faulty one at the time of purchase...0 -
You're better off heading over to the Scan support forums (particularly the after sales support board) at https://www.hexus.net as a number of Scan employees post regularly.
I wouldn't go in all guns blazing as you might get people's backs up, but you might get a better response and/or clarification over their returns procedure than you have now.0 -

I presume that as you paid a lot (over £100) and you bought online you used a credit card ?
If so, you have a Section 75 Consumer Credit Act claim jointly against the card issuer. If you have trouble with the retailer - talk to your card company.

As I understand it they either have to issue with the same model, a reconditioned model of the same card(your card isn't new now so it can offer it), if the same isn't available they need to offer you either the same spec or better at no extra cost(you might find a 285 of any spec might be better than a 280GTX) or offer a refund if they don't want to up your model.New PV club member. 3.99kW system.
