ESA from Jobseekers Allowance

Hi, I have been on JSA for about 9 months and have used up my two periods of sickness so can somebody please tell me what will happen here??

I have just been discharged from hospital with Kidney Stones which the hospital believe will pass in the next couple of days and am still in some discomfort/pain and generally feeling poorly. I am due to see my personal adviser tomorrow to sign on - so can somebody tell me (having had the two periods of sickness) what my options are.

Should I try and struggle in and sign on and tell my adviser what has happened or what would happen if I tell them I am not well enough to sign on. This will just be a short term thing as hopefully the recovery will be pretty quick and I have to attend the Hospital as an outpatient in two weeks time and if everything goes to plan I will be back to normal pretty rapidly.

If you have had your two periods of sick and are then sick again they will close your claim for the duration of the period you are sick. The only way to get paid for that period is to then claim ESA.

The process for this is long. Your JSA needs to be closed, needs to be closed properly, then gets transferred to an ESA office (They are paid off the same system but still needs to be transferred to ESA) for them to pay you. The same process then happens the other way round once you are fit again.

Legally you should declare the accurate circumstances to them and follow the procedures they will lay down but only you can decide whether you are fit and able to work (And/or make it to the JC).
  • If you are still feeling wobbly and feel unfit for work, then you are entitled to claim ESA.

The process should take no longer than making a fresh claim for JSA or any other similar benefit entitlement once closing any previous or current claim.

    'Should' being the operative word.

Just depends on the claim itself and the officers tasked with dealing with carrying out each task in a timely manner.

If you are ill again and they close your JSA claim, requests that they check your claim is closed properly, for some reason some JC+ staff dont close the claims properly and you have wait even longer for ESA

  • Thanks for all the info folks.:T

I phoned in and enquired and they said I would need to come in as it was my signing day - got the feeling that the lady was trying to put me off going down the ESA route. I agreed I would come in but after being up and about for a couple of hours I decided no way I could manage in - so had to make the claim for ESA after all.

    Hopefully everything will go smoothly.:rotfl:

One question though, after switching between JSA and ESA will I be paid the balance of what I was due on JSA or will I lose that??

You should not lose out moneywise if there is no gap in the claims.

As long as jobseekers are aware that you are signing off to claim ESA then you shouldnt not miss out on anything. They might take you not coming is as just another failed to attend and close your claim from two weeks previous if they arent aware.
