Flimsy?

My OH is about to reclaim her PPI premiums from an MBNA credit card -after receiving the SAR documents. The application form has the PPI box ticked and she says that she automatically ticked the box as she always done for all loans that she had previously applied for.
Now that she wants to reclaim(and has seen the light!), I am not clear on what grounds she can reclaim. At the time she was employed by the NHS as a nurse and would have got six months full sick pay and 6 month half pay and also had a pre-existing back condition (albeit not too serious).
She also stopped the PPI payments back in 2005, after taking the card in 2002.
I have had a go at the template, but it seems a bit flimsy to say that the details of the policy were not fully explained to her - as she never actually asked - and that she had a pre-existing condition, when she had only been to her GP with it (is that a "condition"?)
Any and all help & guidance appreciated!

Hi there
If they added this without explaining this to her I would write this and tell them if this was explained on the purchase of this finance, that it would be unlikely the PPi policy would have been accepted, due to being already protected within the NHS.
And of course if your O/H has a pre med condition I would also explain that as well, as this would not have fully protected her.
My hubby has pre med conditions and cannot make eligible claims and have been successful through the FOS.

The PPI comes to about £1500 but at face value it looks like she asked for it - but I understand that does not mean it was sold correctly.
I will draft the letter tomorrow and post it up -and would be grateful for any tips?

They always make it look as if we asked or agreed to it, but a few years back they are also known to have just given the agreement to sign, and add the ppi part of it later on.
So just as long as all the reasons your OH has, add them all, and they should also have made it optional, mention this as well.
