I didn't raise the point of what was packed and how it was packed. My original post refers to the fact that delivery contract is between the seller and the Royal Mail, hence why only the seller can make a claim. The Royal Mail would be quite within their rights to refuse to accept a parcel for pretty much any reason they wish.
And if the seller came here looking for advice, and I had some advice I could give, then I would.

In terms of the seller and their contract with RM, it's all very irrelevant how the item was packed and whether Royal Mail should have taken the contract or not. Royal Mail don't care how it is packed because they are allowed to break items containing glass, such as a car headlight, and not have to pay any compensation. Of course they're going to take the contract because it makes no difference to them whether they break it or not.
"A summary of exclusions where compensation will not be payable for damage or part loss is set out below.
k. for standard parcels, where damage is to items made of glass or ceramics or which have components made of glass or ceramics;"0 -
Thanks for the advice everyone. I ended up sending a message to the seller saying I had 'got some advice' which after all is true in a manner of speaking
and that I had been advised that I could not claim from royal mail myself or send broken glass- pointing out I was out of pocket and had a big broken headlight on the kitchen counter. He got back to me and said that he had been checking I'd wasn't trying it on and agreed to send a new one. Thanks for the advice everyone, will teach me to read the policies first next time.

Just in case anyone was interested in the headlight saga, the replacement never turned up- seller told me he'd posted it and I'd signed for it but had no evidence. Opened a claim with paypal who told me to post the item back, called them on a free number found on saynotto0870 and explained I couldn't cos of the glass, I was told I could have a refund if I sent a damage report. Managed to get one from a vehicle maintenance tutor at the local college where I'd done the course. Finally after much ringing along the way got my full refund. What a saga but got hung up on the principle!Saving for a deposit. £5440 of £11000 saved so far:j0
