PATAS appeal rejected for being 'out of time'
Hey guys, I made a bit of a boo-boo by appealing 'out of time' to a notice to owner received in October. I'm usually very organised but this one slipped through the cracks!
I received a letter from PATAS today stating that they are unwilling to consider my appeal outside of the 28 days. They stated that under the 'What Happens Next' section of the right to appeal form, it clearly says the appeal should be sent within 28 days, which it does.
The PCN was issued for parking on a yellow in a CPZ, but it unenforceable as the signage is incorrect at several entry points to the CPZ. I have won four cases on appeal for the very same reason (quite funny in hindsight- I was baffled as to why I kept getting parking so many tickets at the time, and it was only on the 6th occasion, when the car was towed away, that I asked the pound the reason behind these PCNs that I realised what was going on!).
This is not a case of ignoring the PCN, as I sent both informal and formal appeals to the council, and then (belatedly) to PATAS. I have also now received a Charge Certificate, which I have also replied to three days ago stating that the appeal was with PATAS.
The PCN is invalid, of that there is no doubt, but what room for manoeuvre do I have now that the appeal process has been rejected? Has anyone else been caught in a jam like this?
Any advice appreciated!
