What to write if claiming for hadrship now?

I see banks are still obliged to look at hardship cases, or fairness, if you are in extreme circumstances. But i imagine that bank charges are not a factor anymore, you would just as well saying to them, "i would like you to give me a random £2000 as i am struggling to pay the bills etc.." rather than, i would like you to consider refunding my bank charges", or am i wrong could bank charges still be used as an argument for hardship?

So what to write now, instead of "i demand you refund all charges" etc, do you write something like,

"I would like you to review my current financial status, i am struggling to pay the bills etc etc...,"

or could you still say something like,

"I would like you to review my current financial status, i am struggling to pay the bills and i would like you to consider refunding past bank charges as i believe these have been unfair especially due to the fact i am on a low income and each charge has vastly outweighed the amount overdrawn "

    Q. Does the hardship rule still apply? Can I still claim if I'm in hardship?

    A. The FSA's hold on banks dealing with the reclaim has been lifted, so there is no longer a specific hardship rule.

However, under FSA regulations, banks must treat you fairly anyway and be considerate if you are in hardship. ...

I'm just about to send a lett off to HSBC. My advice at the moment would be:

-Remove the word "unfair" from anywhere on the letter. This is no longer valid in any way.

-The banks still have to 'be considerate' if you are in hardship, so i just made it clear that it was their charges that were knocking me over my limit and spawning new charges again, and that a refund of my last charges and either the removal of the pending charges or a pre-payment to cover them, would be all it would take to get me out of hardship at this time.

Are you specifically asking for bank charge refund or just asking them to help you out?
