Can I still claim from Natwest?

I started a hardship claim and got a letter from Natwest about 6 weeks ago now saying they would write to us within 21 days with an offer.
Because of the court case result with the OFT can I still claim these or would I be wasting my time now?

http://www.moneysavingexpert.com/news/reclaim/2009/11/bank-charges-qa-door-reopened-for-reclaimersQ. Does the hardship rule still apply? Can I still claim if I'm in hardship?
A. The FSA's hold on banks dealing with the reclaim has been lifted, so there is no longer a specific hardship rule.
However, under FSA regulations, banks must treat you fairly anyway and be considerate if you are in hardship. If you think that hasn't happened you can complain to the Ombudsman (see How to complain to the Ombudsman guide). Though if it's about bank charges specifically it's best to follow the information below.

Q. I haven't yet put in a claim, what should I do?
A. Hold off for the moment while we assess the new law of the land, and investigate the exact result. Ensure you're getting the free weekly e-mail where we will publish an update as soon as possible.
Q. How likely is it I will get my money back?
A. Much less likely than prior to the result, but not impossible. Still, the best thing to do is plan for getting nothing, but cross your fingers.
As we know many people would like a 'what's the chance' type answer, our instinctive guess is even with the new argument there is only a 10-20% chance of most people now getting charges back."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
Have you chased this up when it did not arrive as I would have done and if any offer was agreed prior to the Supreme Court decision or post that decision it would be honoured.I started a hardship claim and got a letter from Natwest about 6 weeks ago now saying they would write to us within 21 days with an offer.

I haven't chased it up. They said they would contact us within 21 days and the court case was 23 days after the letter. I was just wondering if it was worth chasing it up or if they would just tell me to begger off

Unsure if you would get them back - I know for a fact Clydesdale/Yorkshire Bank are rejecting all FD claims at the moment in time.0

That's not what they are telling me. They specifically have confirmed that they are still looking at hardship based on BCOBS rules which they should do anyway.0 -

I deal with the banks regularly and so if someone is what I would say clear on each occasion that I speak with them so to speak then I take their word. If they don't then it is a different matter.
Here is their exact comment:
"The Bank is still considering the outcome of the Supreme Court judgement in relation to the impacts it will have on financial difficulty cases. However, I can confim that the Bank adheres to the princples set out under BCOBS. "0 -
It can;t be re-appealed.reducecosts wrote: »I put a claim in a while ago over a year ago, to reclaim my charges with Natwest and no with this court case decision, it doesn't look very likely I will be receving any money from them.
Does anyone know if the court case will be re-appealed?0
