If anyone is interested.
Morgan Stanley finally refunded me the £160 for the photo display. They repeatedly tried to fob me off and were veeeerrrryyy slooooow sorting it out and seem to keep needing to be reminded otherwise they'd forget or lose the file etc. So it took them from June to October to refund me and there was a bit of annoying form filling in involved too (after my letter which quite clearly explained everything and mentioned section 75). Anyway, they have a special 'section 75' department I believe which (eventually) ended up dealing with the issue.

Hi Folks,
I bought a new BMW motorbike in May 2004 using a credit card for half the money and last month something major has gone wrong in the gearbox. The dealer will not repair it, claiming he doesn't have to as it is out of warranty.
I said the warranty is for convenience and doesn't affect my rights and that a gearbox should not fail after 33,000 miles in four years.
Someone told me to try the credit card company - Does anyone know how far back such a claim can go?

Can anyone explain to me why my debit card is not covered under Section 75 but a Credit card is?
I have to confess that I have just realised this after watching a report on the failing holiday company XL ... I also have to confess to my (I assume wrongly held) view that because my debit card had Visa appended on it that I was covered under the Act ... can someone enlighten me as I would bet that I'm not the only one with this flawed view0 -

The answer may sound tortologous but its because Section 75 is of the 'Consumer Credit Act' and a Credit Card is a qualifying credit product, a debit card isn't a credit product so isnt covered.

Hi, you still can ask your bank to do a chargeback as in Martins advise which can be found here:

They really don't have much of a clue when you ring them as most banks seem to 'forget' to train/mention to their staff that this option even exists; but I have found asking to speak to a manager gets this little prob sorted out ;-)

ps If your bank call centre tells you a manager is not available to take your call, they are talking rubish (as i work in a government call centre, I know for a fact that workers cannot work unsupervised! No matter what they tell you!), at worst the manager could be taking another call, so tell them you're prepared to wait-unless of course your bank always do get a manager to call you back when requested, the Alliance & Leicester call centre staff however very rarely actually pass on your request for a manager call back; I personally think they tell you any old rubbish to get you off the phone & then dismiss the whole conversation; very frustrating!0 -
Watch some credit card companies in particular Barclaycard. I am one of those 200,000 who booked through Kosmar/XL. ATOL say Barclaycard are liable for refund and Barclaycard say ATOL are liable. Bit of a battle at the moment. Mind you the only reason I am dealing with this credit card company is because they recently took over Morgan Stanley who the booking was done through. As soon as sorted they can stuff their cards.:mad:
ATOL have informed me some credit cards are trying to avoid their liability in this particular case. Anyone else having this problem????0 -
Hi Im new to all this and wonder if anyone can help me. Recently I joined an online bingo site (first time Ive ever done this). Money has now gone missing from my bank account bank says it was used on the bingo site. I was on holiday when this happened and had no access to a computer. How can I prove that I wasnt responsible for this. Bank dont really want to know.I asked why I wasnt contacted when large amounts of money was coming out of my account there reply was What difference would it have made. I am really sick with worry over this.0

I have reported them to trading standards based on my experience, I suggest if you've had problems you do the same..
