hi i had an issue with a TV and stand i ordered over the internet on a Morgan Stanly card.
After 3 weeks i get a TV and no stand and had alot of hassel off the company and 2m later managed to return it and then had to wait another 4 weeks for a refund. (apparently the model they had never came with a stand)
Morgan stanly did nothing and said that as the internet compnay had used a third part merchant Novex or something (ie some pay pal type thing) then the credit cards liability didn't exist and i should take my complaint up with Novex or who ever it was.
After 3m's of effort on my part i managed to get a refund from the company but it was looking very doubtfull and i used on of the safe web site Trust accredation link thing they had on their web page.
Martin's article is helpful on section 75 stuff but i am not sure how easy it would be to apply. I wasn't aware of it at the time and didn't quote it.
I wrote 4 letters to Morgan Stanly and their replys all said tough luck go to the FSA if you want its not our problem.
To make it even worse i was also over charged for the TV so i effectively hadn't recieved the goods i ordered at the price i agreed.

I love my credit cards for all the reasons Martin mentions plus two more. It stops me having to do a spending diary or keep receipts. They get burned. Another reason is you cannot fritter so easily and when you can't use the card you can't spend ya money.:T

Hi, I have had exact same issue with same company!!
This JMC Trading / JMC Furniture company seems to take orders, charging card and never delivering.
What can be done outside of reporting it to credit card companies? Surely law enforcement should be interested?0 -
I had a similar problem when i bought two small silver boxes, which were supposed to be MP3 players but one was dead on arrival and the other has never worked properly with a string of serious faults. Even though I contacted them promptly (hard enough considering they proudly boast the only way to contact them is via e mail) they wanted to charge me delivery for a second time so that the goods could be fixed - when i requested that i just bring them to them (they are local) they ignored this request and thus commenced a series of nonsensical correspondence in which they ignored all of my main complaints until they were able to tell me the 3 month guarantee had run out and would i please leave quietly.
My local Trading Standards did nothing but delay me, and when i went down the route of section 75, Barclaycard took another 3 months to tell me I couldn't claim as although the joint purchase (at the same time) was over £100, each individual item was not. I'd been planning to cancel the card anyway...
I'm currently plotting how best to get back the £160 this company thieved from me whilst remaining within the law, but I take some consolation in telling each and every person when this sort of thing comes up in conversation (and others have shared similar experiences so i'm not alone), that Dabs are crooks, so...

I do the same thing, use my credit card for all purchases, especially internet ones.
My story:
I bought my girlfriend an MP3 player for her birthday, 3 months later it breaks down and refuses to work. We contact the company they tell us to send it back with a form, which we duly do (registered post of course). We wait a while, nothing happens. So we try and contact the company and found they went out of business and is uncontactable.
So we I did was to contact the credit card company with a nice letter outlining their responsibility under the consumer credit act and explaining the situation. They ask for proof we bought and sent it back. So I send them a copy of the postage reciept and invoice. And hey presto, they refund the cash.0 -
After reading all horror experinces now i know why it is better to purchase from credit card.Last year Uk based Midland Airways had gone bust with hundreds of travellers left in lurch. It's better to pay 2% extra than taking risk.Does this thing also applicable on cash back offers as some mobile companies charge 1 pound on cc to authorise the order.0

I purchased a philips digital photo display last November. It since broken after I applied the latest firmware from their website. The website I bought it from (nickknows) has gone bust. I phoned Philips. To start with they tried to tell me to take it to any shop that sells Philips things and the shop will exchange it for me. None of the shops I tried would do that (funnily enough). Eventually Philips agreed to send a replacement (this was a month and a half ago). The replacement has not arrived. I have spoken to them 8 times in the past 6 weeks and on 4 of these occasions they have told me they that they have 'ordered a new one' (with various excuses about why the last one didn't arrive). Each time nothing has arrived.
I think it's time to turn to my credit card company (Morgan Stanley). I hope they can help... It does put you off buying from unknown companies on the internet that's for sure.0 -
I would like to know Martin's views when as in my case a holiday company wants to charge an extra two per cent if payment of the balance is made in cash. In my case that figure would add around £25. Is it worth paying that extra for the consumer protection? I had the same dilemma when I had replacement guttering and new wood floors. The firms imposed a credit card charge. Pauline H0

Pauline, I use a 2% paying cashback card normally (or 1% paying if they don't accept Amex), then you have to balance the protection you are getting.
With holidays you may also have ATOL protection, and travel insurance protection in which case if you need to pay extra it probably isn't worth it. It's all a balanceMartin Lewis, Money Saving Expert.
