Hi - some quick advice please.
Had a 12 month membership from Mid Nov 08.
I stopped going for personal reasons. Telephoned Gym 12th October to cancel (30 days notice required), and i was told to put i writing.
I did, sent to Gym. Cancelled DD with bank.
Easy Collect say letter never received. They say i should have sent letter to them, not Gym.
Asked for copy of Contract, and yes it does say that in the small print.
I don't recall receiving a copy of the contract but in any case surely i should be able to rely on advice from Gym (they said put i writing so i assumed to them).
Easy Collect say they want another £30 as 30 days notice not received by them.
Now £30 is £30, not a lot but something i cannot really afford right now.
The contract is a Fixed Sum Loan agreement regulated by the CCA 1974.
Any quick advice? Is CCA covered by the FOS? Thought i might just threaten to escalate to a regulator and see if they back down.
This is more a principle thing as i feel that i've done what was asked of me.

Just contact Easy Collect. I had a gym cancelation last year, and they mistakenly took another payment. All cleared up after a quick call.0

Thanks for the reply. Done that - they want their money.
Times must be hard.
Just noticed that the Key Financial Information has an error on it.
It say "minimum amount payable £264 over 11 months at £29 a month"
First pymt paid in cash.
They seemed to have worked out the min amount on "£24 a month".
I think i'll tell them they owe me :rotfl:0
