ESA the suspense is killing me!

I appealed the results of my ESA medical assessment as i scored zero on sept 1st- over 3 months ago and still no news

I just want to know how long people have had to wait?

i know it can be up to 6 months but just wanted to hear peoples stories of how long they waited!!

if it did take exactly 6 months are you more likely to win the appeal??

surely if they didnt think you were entitled to it they would just see to your claim straight away so that they didnt have to pay you the £64.30 per week

if i do win i will get massive backdated payment though i guess

    Is it three months since you sent in your ESA50, or since the medical? If the latter, three months is a long time (though not unheard of). Have you contacted the JCP to ensure that everything is going through ok?

    The length of time that an application takes to process has no bearing on the success/ failure of the claim, or the result of any appeal.
    Gone ... or have I?

    i meant i appealed 3 months ago








    I had the outcome of my medical assessment 3 months ago which scored zero

    then i appealed immediately, even hand delivered it so it is exactly 3 months since that appeal

    OK, you've now edited your first post!

    Six months is quite realistic for an appeal, and the time taken has no bearing on the result.

    Appeals usually take between 3 and 6 months, so it could be a while yet.

    Has the appeal been heard but or are you waiting for it to be heard?

    Are you going to the appeal?

    The point, I think, of paying the £64.30 is that most people (The Benefit switchers anyway) would have claimed JSA anyway and that is paid at £64.30 so there is less cost in keeping someone on ESA than there is in closing a claim and basically processing the same claim again (Its even paid off the same system).
  • I just filled in the gl24 form to review the decisonn and i got a response back saying that if they could not revise it in my favour then they would send it to the tribunal and that was 3 months ago, ive heard nothing else nor been asked if i wanted to go to any appeal meeting?

    didnt know u could go!

    Do you mean whilst appealing? No, that's just a horrendous error that DWP legal group are frantically trying to remedy

    I'm only talking about the initial appeal though. I thought it was a 'policy intent' to pay people at the assessment phase rate for the initial appeal but that after that it was a legislative !!!!-up.

    DO NOT ever ask for a review of any Incapacity/DLA or ESA decision, as a review will be sent straight back to a 'decision maker'...who have incidentally already decided the outcome in previous correspondence to you. 90% or more of these requests result in this and them saying NO.

    If you feel that you have been unfairly treated, ALWAYS APPEAL the decision rather than ask for a review....and remember the 1 month timescale and your rights.
