Hi all
Here's the problem - got a 80gb Ipod Classic (back in 2008 through a mobile phone deal). In July 2009 the ipod had an epic failure (red cross). I took it into an Apple store in Birmingham, and they replaced it on the spot after checking it. I was told that it was a common problem with this model.
In November, the same thing happened with my new replaced Ipod. I took it back. I was then hit with the news that every Ipod has a 12 month warranty period, and I would have to pay £80 to get this fixed. I complained and stated that this was a new Ipod 4 months ago, and was told that replacement Ipod's only have a 3 month warranty.
Buying a new Ipod or paying the charge to fix the Ipod are both currently out of my price range.
I rang Apple services to complain and got through to Customer Relations. After speaking to Alan, I was informed that under Apple's terms and conditions the Ipod I recieved as a replacement for the original one was NOT necessarily new, but potentially a refurbished one. I mentioned my rights to have a product that was fit for purpose, Satisfactory quality etc - but got no where. Worse still I was told that this is always the case for any returned product - they will not commit to giving you a 'new' product.
Is this right? Can apple effectively refuse to replace my already replaced IPOD? Shouldn't something work longer than 4 months - even if it is a replacement? What are my rights here?

There's no point quoting "fit for purpose" or "satisfactory quality" etc to Apple, they are simply the manufacturer and are not bound by the SOGA nor do they have to offer a further 12 mth warranty on the replacement. You have no rights of redress with Apple, you should have taken it up originally with the retailer.0
