She asked me where I got this information from, so I used one of my favourites...."I'm not at liberty to divulge that information" :D I quoted the section 11.7, and she advised me to take my "booklet" into branch with proof of the charges so they could deal with it.......any advice from the REAL experts?? ;)

    Yes, I have never heard of consequential losses either so I am definitely interested if any such thing DOES occur. Needless to say I am an interested spectator for the time being.

  • Look up the Originators Guide and Rules to the Direct Debit Guarantee......all banks should hold a copy of them :) HTH

    I did say they probably wouldn't know anything about it. It's very rare to find an average bank staff member who does ... but someone in head office should know.

    ... and yes, someone in head office should have a copy (or be able to access online) The Originators Guide and Rules to the Direct Debit Scheme.

    It's all in there in black & white :)

    If I worked for the bank, I would already be searching for the information......I don't so can't, lol.

    Will see what the bank says but am very intrigued.

    EDIT: I've just read the relevant clauses and NOW I AM EXTREMELY interested and even mildly amused at how the bank will deal with this.

    That is correct, it is up to the Payer to provide proof of any consequential loss so that the Paying Bank can attach them to the claim, but in the case of bank charges made by the Paying Bank, those losses should be self evident :)

    (Consequential loss can be for almost anything, but bank charges incurred are the easy ones to prove and get accepted - the bank already has the evidence)

  • natweststaffmember - Thanks for pointing that out, yes I do already know this as I have looked it up, and Premier has provided relevant info. Btw, why are you amused as to how the bank will deal with it? :) I know it's hard to gauge someone's "tone" via text, but what's the problem here?

    Premier - that's what I'm going to be claiming for....that's where my losses have been. I was going to bring the statements into the branch, but will they be able to (yes I know, obviously they SHOULD) just do it from their end? I'm funny about parting with statements - I need them for my records anyway. I'm in town tomorrow so I want to do this then, so I was wondering if you could just tell me the steps to going about doing this (so I've covered everything and don't get stumped and have to go away and come back again!). Basically, we've established that most workers haven't been trained to deal with this sort of query, so how do I get this sorted in branch if it's highly likely none of them will have a clue?? Thanks in advance for your help!

    I wouldn't give the original bank statements as proof of your loss. Take photocopies, or better still let the bank take copies themselves if they won't supply their own copies (which I would have hoped they would in the circumstances).

    There's nothing else for you do do. The bank is required to raise the claim. In the old days this would have been a pre-printed form which they fill in a few boxes on and then send to the originator, although I expect they may have automated this by now. (how they attach documents electronically I'm not sure, perhaps they have to scan them in)

    If the branch staff say they don't know how to make a claim, ask to speak to their manager, ... and then their manager's manager and so on until you get someone competent in knowing how the Direct Debit Scheme works. :)
