    Totally agree with you on that one.
    Just tell the truth, how it hurt etc, they will decide how much you will get, and you can claim for any loss at all..work etc...your solicitor will help you!

    I had a side impact crash in 1998 which was whiplash and back injuries, we fought to hell and back for compensation, it took 3 yrs to settle, dispite the other driver was found guilty through the court system 6 months after the accident.

    Then in 2000, I had another accident (must be they didn't like my red car), that was a complete right off, the bloke behind hit his accelator peddle instead of his break, I ended up of work for 3months...
    although I got basic company sick pay, I lost overtime etc, (as I had the back-dated payslips was able to claim loss of earnings), but the medical issues were as you've already recovering from one accident, we won't bother too much with this......

    WRONG MOVE

    As when I had my DD in 2002, the full extent of my back injury became apparent, my back couldn't cope with a pregnancy, I ended up in and out of a wheelchair, being given crutches now 7 years later, I'm permanently on crutches, registered disabled and 2in shorter...

    Most people that try to claim for Whiplash on Insurance, don't really have it. They will start to feel symptons once they think about the money they might be able to claim.

    Insurers are facing an increasing number of such claims and this is pushing the premiums up for everyone. Therefore Insurers are now trying to clamp down on this by making the process more difficult. My sister had a crash a few years back, causing her an injury to a knee and neck, as well as two of her children also with whiplash. The 3rd party Insurers made the process longer, wanting several medical opinions and it ended up in court. The court decided to award payments to the three of them, but it did take over a year.

    My advice therefore is only to proceed with the claim, if you are willing to have further medical assessments and ultimately discuss your injury in court if it gets that far.


    must have been severe, they dont use neck collers anymore for whiplash the doc told me why but i cant remember anyway i told him i wasnt in much pain and that it was just burning i even showed him i could turn my head he said i would be in a lot more pain tomorrow and he was right it has got worse these past few hours and has spread across my shoulders im not wanting to claim tousands i just want to claim what i would earn had i been able to go to work, i would rather not make a claim as i would be claiming againt someone i work with but i cant afford to loose a weeks pay

    It's too early to know you need a week off. Get to bed and see how you feel in the morning. (Keeping on hitting your keyboard is only making your symptoms worse.)

    I'm glad someone eventually said it. Don't assume at this stage that you'll need time off work. It is perfectly possible that by tomorrow morning your symptoms will be much worse and you will need that week off work, but equally they might not be that bad and you'll find that you can manage to work. Just see how it goes. You've got three years to make a claim for the injury, if it proves to be severe enough for that, so you're in no rush.

    Reading half the posts here makes it sound like the script writers for the ambulance chaser adverts have all been posting.

    If you are in pain you simply go to your GP or the hospital and tell them what has happened and what you feel and they will decide what the diagnosis is and the treatment. X-rays dont show up soft tissue and so are of no use for whiplash.

    What do you do for a living? Most people will normally get full pay for a period of time off work sick before going down to statutory sick pay. If you do end up being off sick long enough for SSP to kick in then the third party insurer will pay the difference between your regular wage and SSP so that you are not out of pocket (assuming they accept full liability).

    im a communtiy care worker on o hr contract so if im not working i dont get paid.
    today there is still the burning pain, i have shooting pain down my right arm and pain across the middle of my back its less painfull if im standing which is what i have been doing for most of the morning

    If you are on hourly contracts I would assume that your hours fluctuate a fair amount. If this is the case they are going to want to see a back history of payslips to work out what your average income is. If the hours have increased significantly recently then you will need to get something to prove that this trend would have continued (ie letter from employer/ agency)
