Default notice on credit card

I recently asked natwest to provide proof of a letter of default was sent as it is showin up on my credit report but wass paid in full 6 months ago.

i got this reply.

thank you for your letter...

your request for documents contains some misconceptions about your entitlement to information in a specified form and out obligations to supply that information.

as you are aware this account has been fully repaid and therefore there is no active agreement between natwest credit cards and you with regard to th above account.

the consumer credit act is for active agreements and therefore there we are under no obligation to provide you with the requested documents as your obligations to us under the agreement has ended.

help? what do i put no. egg hae agreed to remove the default on the account im not sure why am havin so mjuch trouble with natwest :(

thank amy

you need todo a subject access request
  • Did you fall into arrears to make them send you the letter?
It will not be there for no good reason even if you have paid off the debt now - this will now show as settled.

Yes, they are correct in that they do not have to provide you with details of the default if the account has been settled. However, if you were not notified of the default and given the required 14 days notice (it is called 14 day notice before action letter) then the default is void and should be removed.

You could try arguing but to be fair the best thing to do would be to SAR them.

I am lost as to why you mention Natwest then suddenly go into egg, did you also get a default with egg and they have agreed to remove it? If so fair play to them, they do not have to!

SAR is here (costs £10): #14
