Credit card debt, benefits and going to court

I hope someone can help me :( I'm in £650 in debt (not alot compared to some stories I have read) im on benifits. I was paying £35 a month and accidently didnt pay 1 month (its not taken directly from my bank account)

I then got a phonecall from a debt crediter, demanding £650 full payment! I said I couldnt afford that and offered to up my monthly payment to £50 - answer was no! then they said we will accept £218 a month, and must be payed on the 17th of each. (obviously i cant afford that) They said otherwise you will get a summons to court.

A) I don't own anything. I have a bed and a crappy wardrobe.
B) I cant afford anything like a solicitor or anything like that
C) I dont know what to do!

Im still going to pay some form of money from the card - but as they still demanding I can see its a case of going to court. Any advise that could be given would be appreciated. Seems really stupid to take someone to court who hasnt got nothing yet it could be payed off in 4 months.

Thankyou for any help!

They're lying - they won't take you to court. They say that to everyone.
They'd get very little in court (if anything). Just the summons would cost them £60 if they filed online.

Dont worry about those silly little threats. They are designed to frighten people in to paying them.

So dont worry, pay what you can afford and ignore these phone monkeys
    For everthing else there's mastercard.
    For clampers there's Barclaycard.

dont deal over the phone and offer in writting by recorded delivery. Debt collectors are judged on results. So the faster they get it in the better, they cant do any more than the milkman. If they take it to court respond online and offer payment

Tell them to go scratch - then tell them that they can either accept your offer as its the most you can pay or you'll be quite happy to see them in court and show the judge what your finances are like and let the judge make an order for the £35 that you're already paying at the most.

Bet they won't take you to court. Debt Collection Agencies are long on threats and short on "do"
If you don't stand for something, you'll fall for anything

Your credit rating is shot to pieces anyway, so if you are not so bothered of that fact, then do tell them to take you to court if they refuse to accept your offer of payment as much you can afford. They won't as it will cost them money and time!
  • I would advise a visit to your local CAB.
You might find that you may have to pay less each month not more.
