Accidental Order

I was trying to sign up to very.co.uk but accidentally ordered £66 worth of xbox 360 games or credit :confused:

I rang the company and they have canceled one of the orders but have said the other may be sent and that i would have to refuse delivery because it was being sent from the manufacturer. (its an xbox 360 game)

Will i get the item refunded if i refuse delivery? (This is what the women said to do on the phone)

Will i ahve to pay the £3.95 delivery charge? Anyone had any experience like this with very.co.uk?

    Email them to cancel the order, you then have physical evidence of cancellation.

    Under DSR you can cancel before delivery and you will not pay anything as ALL costs have to be refunded inc outgoing P&P.

    "3.23 Where the DSRs give consumers the right to cancel an order, this right is unconditional and begins from the moment the contract is concluded. Unlike when buying from a shop, the first time that a consumer will typically have an opportunity to examine goods purchased by distance means is when they receive them. The DSRs give consumers who buy by distance means more rights than consumers who shop in person. When a distance consumer cancels a contract to which the cancellation provisions apply they are entitled to a refund of any money they have paid in relation to the contract even if the goods are not defective in any way. Please also see paragraph 3.46 for further information."

    From page 22; -
    Can a consumer cancel an order before they receive the goods or where goods are lost in transit?
    3.35 Yes. Where the DSRs give consumers rights to cancel, this right is unconditional. If consumers cancel before they have received the goods you must refund the total price of the goods, including any delivery charges. Consumers who have cancelled under the DSRs may refuse to accept delivery of the goods. Refusal in such a situation cannot be treated as a breach of contract."

  • thanks for the reply... i filled out an order cancellation form like 5mins after the order and got a reference number from them will this be enough proof?

    If my order status hasnt changed tomarrow ill ring them again telling them that they wont be getting a penny from me as i have given them plenty of time to cancel the order... am i legally right in saying this?

    The point Anihilator is making is that it is not easy to order £66 worth of stuff on credit by 'accident'...as you call it! Someone at the company you ordered the items from is now having to sort out the mess you created and the company will not see a penny from you. Who do you think pays for your mistake?

    in my experience, very have mostly been pretty good. if you ring them and tell thm it as cancelled before it was sent out then if you hav been charged they will normally credit it back. ive ordered something from them before, two weeks later it was delivered, then i noticed it was cheaper on the website so i called them and they credited me the difference (even tho i should have paid the price it was when i ordered). but i would advise to be polite and friendly when talking to them, a bit of manners goes a long way, if you were them, would you want to help somone who is shouting odds at you and generally not vry nice to talk to or someone who is pleasant and friendly:confused:? having worked in retail and getting my own way quite alot with various companies it definately gets you more results.

    so i would wait and see if the item gets delivered first then give them a call, if you've tried the be nice route first with no sucess then by all means shout the odds.


    edit to add, when i have cancelled things they have told me to refuse in case it gets delivered, sometimes it does get deliverd, somtimes it doesnt. and to be honst, i am also a bit confused how you could accidentally ordered, or do you mean you we trying to see if they would accept you for credit account by putting things into your basket then going through checkout?

    @ gordikin... If i ordered by accident or just changed my mind the point is irrelevant, i am well within my legal rights to cancel an order before i have recieved it. If i want to cancel an order it should'nt take a number of phone calls and emails to get it done... and i certainly shouldn't have to refuse delivery when i emailed to cancel the goods about 4 minutes after the order was placed.

    I am being polite and apologetic towards them as i understand it is my fault, im just trying to sort it out before it escalates

    By accidentally ordering i mean i wanted to set up a credit account but was unaware my son had put items into my basket, which they then took the value of these items from my credit assuming i wanted to purchase them, after i made the account.

    But, seeing as it is your mistake, don't get angry about it, talk to them nicely and everything will be fine!

    please don't think im trying to be difficult, its purely from my own experience, but when i hav cancelled things from very i hav normally only ever phoned them once, i never had to fill out a cancellation form? is this form to close your credit account or just cancel the order?

    as said in previous post, ive never had any problems getting them to credit me P&P hopefully this will be your case, when did you originally order? it does sometimes take them a while to update orders.



    i see what you mean about opening the credit account now, i have don it a coule of times as they dont empty your basket, so if you come back a couple of days latr and order something else the previous itms are in there too (hence my cancelled orders lol) and yes i know i should read each page thoroughly and realise but Meh, we all do it sometimes :D

  • i may have given the impression i have been harsh on them, but i have been very polite on the phone and i do know it was my own fault, i was just trying to find out the best ways to cancel from this company and if refusing delivery is a common way to return goods to them :confused:
