Returning PSPs to Argos

Options
My sister bought 2 PSPs from Argos, 1 today and 1 yesterday. She then saw a much cheaper deal in Game, and tried to return them to Argos for a refund. She was refused a refund on the grounds of the items being exempt from the money-back guarantee, as told to her by the cashier at the time of purchase and printed on the receipt. The problem being, she wasn't told on either occasion by the cashier about the exemption at the time of purchase, and you wouldn't really look at your receipt unless you need a refund? Besides which, once bought you can't have a refund anyway so it being printed on the receipt does not make much difference? The store manager will not be available until Monday to discuss, but does anyone have any advice in the meantime please from a legal point of view? Any replies appreciated.

From a legal point of view, she has no right to return them. Sorry.

It will have to be at the managers discretion - but remember he has discretion to say "No"

If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

  • As far as I am aware there is no legal requirement for a customer to be verbally told that a refund exemption applies. I've noticed this policy on Argos receipts, in their catalogue, on their website and around their stores so I don't really think your sister will have much luck unless she finds the manager in a good mood!

It is stated in the catalogues and sale leaflets unfortunately. My Mum had the same problem when she let my 12 year old little brother buy a freeview box. The area in which the Argos is situated, and where she lives doesn't even freeview reception but they refused a return.

This is clearly stated on line and in the catalogue so whichever method she used to buy them she would have been able to see that they are excluded from the 30 day money back guarantee, perhaps she should have shopped around a bit before buying, it's easily done, with comparison sites everywhere on-line...

    No recourse in law.

She'll know to shop around next time.

No right to refund unless item is faulty or not fit for purpose.

  • I would go to the doctor and ask for an arm shortening operation, that way, in next years christmas rus to be relieved of your money, you arms may not reach deep enough in the pocket.

    Short Arms - Deep Pockets.
