Plz help re Credit Card debt under / over 6 yrs?

Please could someone advise me my best options….

I am going through a divorce at the moment and 7-8 years ago my wife ran up a huge debt with my credit card (£3000), withdrawing cash from ATM’s without my knowledge. This cash was squandered and over time it came to light along with several other debts (utility bills, catalogues, and loan companies).

I was under the impression the debts were being paid off by a debt consolidation company which she was making payments to.

Now some time on I have been contacted by a company asking for payment for the Credit Card.

I read in the forums and believing no contact had been made for over 6 years I wrote a standard letter quoting the limitations Act 1980.

They replied:
“We acknowledge receipt of your recent communication, the contents of which have been noted.
You have advised that this account is covered under section 5 of the Limitations Act 1980. However, this does not apply to your account as we note from our records that the last payment made was on the 13th September 2004 for £95.41.
We trust this now clears up all of your issues and look forward to receiving your proposals of payment”

Amount currently outstanding: £3,662.66

Any help would be appreciated.

    They seem pretty sure of their information, which you are not - you need to do whatever you can to fully uncover your wife's financial affairs. If that last payment date is correct then it isn't statue barred I'm afraid - so should form part of the assets and liabilities considered in your divorce settlement.
