Can i win my claim on a technicality?

My hearing at Court for o/standing bank charges was dated for 2 days after the stay was put in place.When I first started my reclaiming process (which was with the Woolwich) They informed me quite early on that it would be dealt with by Barclays and the details would therefore be passed from the Woolwich to Barclays.
This took 3 attempts and took 4 weeks because every time I called up to see if the details had been passed on the Woolwich kept telling me that 'for some reason the details didn't get sent over and they would deal with it now as a matter of urgency' and eventually,4 weeks later,the details were passed on.
As this held up the process for 4 weeks I believe this has obviously meant that I was 4 weeks behind with everything else and therefore had the Woolwich handed over the paperwork promptly I would more than likely have had my Court date before the blanket ruling on the stay.Does anyone think that this is a reason to go back to the bank and try to claim on a technicality?
I would appreciate any comments/help with this

Unfortunately I don't have it in writing but on 21st Dec 06 I received a letter from the Woolwich which explained that they were handing it over to Barclays and my 1st correspondence from Barclays was 18th Jan 07.Since Barclays did take the case over they were very quick to respond to me,usually no longer than 48 hrs,so this must carry some weight?The Woolwich state in the above dated letter that they had already escalated my complaint to Barclays so if I can get Barclays to confirm in writing the date that they actually rec'd it would this be of any use?
Yes it is still with the court.

If it is still with the court then the case is stayed and not won, any delays are irrelevant I'm afraid.0
