Help Please - Payments being taken from Credit Card

I hope someone can give some advice?

I signed up online for a 'free' trial of Smile Bryte teeth whitening and gave my credit card details - as far as I could see there where no T&C's and the only thing I was paying for was P&P. Now 2payments have been taken from my Capital One credit card (I only have a £200 limit as I am trying to build my credit back up) and this has put me over incurring charges. Capital One can't cancel it as its a CONTINUOUS payment (so more of these are going to come out!)and they gave me two numbers to ring Smile Bryte which are both dead. I have emailed Smile Bryte telling them I want to cancel and they have demanded a phone number - they won't give me a number to ring them and after me giving them my mobile number they haven't rang me. Where do I stand?

I am by no means a stupid person and always read the T&C's when I sign up for anything and can't believe I have fell for this I am sooo angry with me and them and Capital One!

    Query the indifvidual payments with Cap One if you didn't signup for a CPA as unauthorised. Assuming Cap One agree and refund the values they should also refund the charges if these payments were the sole cause of you being over limit.

    Don't be angry with Capital One - it's not their fault. They cannot cancel the transaction. It has to be cancelled by Smile Bryte.

    That said, if you can show Capital One that you have tried to cancel and still charges are being taken, then they may be able to help. Write a letter to Smile Bryte and send it via recorded delivery (so you have proof that it's been received) saying that you want to cancel. Then if they continue to take payments you will the proof you need to go back to Capital One.

    Thank you for the advice,

    Capital One have actually now put all the payments on hold and are sending me a dispute form. The company in question had 7payments pending on my card all under different company names and for different amounts, they don't have any phone number or address and apparently continuously close down websites and open new ones with different names. I am astounded, annoyed and mostly embarrassed at getting caught out like that, I am the last person to ever get scammed (first time for everything it would seem) and always check everything - I must have had a brain burp!.

  • I work for a credit card company and unfortunately have to deal with several customers a day disputing transactions from this company, they tend to put several unauthorised charges through onto the card varying in amounts under names such as pristine health and brightsmile and healthysmile.

    They are called "Smile Bryte" becauase they will smile gleefully once they have procurred your Credit Card details.

    Sharks!! Dispute all the transactions with Capital One and you should get your money back.
  • Anyone who has to register credit or bank account details for any ''free'' offer should look at this with deep suspicion.
    If it is 'free' why do they require your details??

    Just a quick update, I have had word back from Capital One that they are upholding my dispute and will be monitoring my account for any more unauthorised debits from Smile Bryte or any parent companies.
