    There is an allowance for step children in the protected income part of the calculation, where there is also an allowance for your partner. Be wary of the overtime trick as they can approach your employer at any time afterwards and ask if you have resumed doing it or whether the lack of it is reflective of normal earnings - they have done this as they got wise to the trick you are suggesting.

    How old is the child you are being asked to pay maintenance for?

    i phones up child support solutions today they rang me back well left an answer phone message saying i can arrange an appointment at a cost of £150 has any one had any experience with this company or am i flogging a dead horse

    You do not need to part with your £150. Don't do it. You can get all the help you need here.

    Going back to the arrears. It must have taken time for them to do the reassessment and arrears will be back dated.

    I would be asking for a complete account breakdown that they must supply.

    Kelloggs are our resident expert on CS1.

    You can't get the amount reduced if all the details they have assessed you on are correct. Correct income, correct number of children at home, correct number of nights child stays over, correct housing costs etc etc.

    Your only chance to get it reduced really would be to keep an eye on your income for the next couple of months and see if there is a drop due to lack of overtime done and then ask them to reassess you again as the overtime you did in the past two months was unusually high.

    Edited to add, that obviously only applies if the assessment they have done is correct. You need to check that first like Sensemaya (excuse me if spelling is wrong) has suggested.

    You need a complete account breakdown. The usual ones are totally uncomprehensible and vague. The CSA are also notorious for making inaccurate assessments.

  • I would like to say thankyou very much for all your help i have just a few more questions that hopefully someone can help with .

    As your aware i've been instructed by the csa to pay £400 a month this i feel is far to much considering the 2 wage slips they had off me had lots of overtime on them.
    Here's the question can i do 2 months standard hours then ask them to reassess me
    have i any options or avenues

    You can ask them to reassess you - but beware that if you then revert back to doing overtime, they may then reassess you again as they can (and often do) go direct to employers to check that you have not started doing overtime again. Basically they have got wise to the reducing overtime to reduce your maintenance idea and have ways to check to ensure that you have really stopped doing it.

    If you did overtime as a one off, then you should certainly ask for a reassessment as your circumstances have changed.
