TC overpaid HELP ?

Just had a letter from the TC saying that I filled the form in wrong in 2003
They said that i claimed for disability allowance, which I was entitled but there is two parts to it
One is disability allowance {DLA} which you get £2000
Part two a disability allowance {DLA} for the higher care component which is £800
They said that I filled the form in wrong when my wife claimed for TC and have just noticed that I do not get the higher care component on the DLA
And they want their money back
My question is how far can they go back and why did they take so long to notice the mistake

technically no 'debt' can be taken to court 6 years after it's accrued (with a bit more detail than that!) but as your well within that, they are within their rights to get the cash back, they would normally cut your current benifits and recoup that way - can be done by as little as a few ££'s each weekDon’t ask what the world needs. Ask what makes you come alive, and go do it.

For the normal person there is a 6 year limit however the OFT recommends that if chasing of the debt has been "continuous" within the period of the 6 years then the 6 years shouldnt apply.
I believer however that as benefits come from a government agency they are exempt from this limitAll posts made are simply my own opinions and are neither professional advice nor the opinions of my employers
