Incapacity / esa or income support or none??

I hope someone can help please.
My daughter ( 21) currently lives in a private rented flat with her partner.
Last year she was not well and claimed esa for quite a long time, but eventually had an assessment and they said she could not claim anymore so she had to move back home & eventually got a bar job, this was not good for her health so she had to give it up ,6 months ago she got a job in a shop as was a bit better, she moved to a flat with her partner, but now has had to leave due to illness.
She has not claimed anything yet as not sure what to claim, her partner is paying the rent & bills at the moment which is not feasable for long, as normally they each pay 1/2.
Her doctor has told her not to work for a while but as yet has not issued a sick note or anything.
Advice please.

    She would not be able to claim IB/IS as all new claims need to be for ESA.

    If she has paid/been credited with enough NI contributions she may get conts based ESA.

    She would not get income based ESA due to her partner working.

    Im not sure on this. But without a doctors note or other proof of medical problems/condition she would be classed as unemployed and eligible for JSA. Although if shes living with her partner and hes working full time she may not be entitled to it. If she is unwell then she should seek professional help and make a new claim for ESA.

    This very true but she would also need a sick note from her GP in order to make the claim. I'm still unsure why her doctor hasn't issued one since they've requested her not to work.

    If the current illness is related to the previous bout she could potentially get linked back to her previous claim under the 104 week linking rules but she would have needed to complete the necessary paperwork at the time her claim ended to do this. She'd still need a sick note though.

    Obviously to claim ESA you need a sick note.

    No she will not be able to claim under the linking rules as her benefit was stopped after a medical assessment.

    The linking rules apply when someone stops claiming IB and starts work and then stop work due to illness and can claim again.

    If she claims ESA within 6 months of a "failed" medical a new medical may be required before any money is payable if she is entitled after presumably not making the NI conts for the qualifying years and having a partner that works.
    Debt free = December 2010...as of March 2006 it is now January 2010..... as of December 2008 it is now December 2009 :j hopefully sooner!!
