county court letter due money outstanding please help

The cleaning company have sent me a letter through the courts due to outstanding amount that i owe to the company, the fact this wasnt paid originally was an oversight due to me being on strong mediciation and had forgotton to pay,
A number of times i have mentioned to the cleaner i could give her a cheque to pay the bill to the company but was told dont worry pay next time!!!!
eventually without realising the bill went up to £234 which she sent a letter to confirm this
she hadnt at any point tried to contact me till to let me know the bill was going up.
when i had phoned to ask about the bill she was really nice and said that i could pay off as and when i could as she knew i wasnt in a position at the time to pay off the full amount.
She stopped the services at that point.
Then we came to the arrangement of paying £20 a week until debt cleared.
I had paid 3 weeks out of 4 since the agreement but forgot to pay for 14 days again she didnt contact us to ask about payment.
at no point has she threatened or warned me of court action and if she had contacted us either by phone or letter to say she wasnt happy with the original agreement i would have cleared the outstanding amount.

where do i stand on this??

    Check out hmcourts-service.gov.uk. There are pre action protocols to follow before court action should be taken.

    Like discussing it with them and letting them have a repayment plan :rolleyes:

    Not a great position. You have been sued and you do not appear to have a defence. Pay up before your credit history is ruined and the costs increase further.

    Pre-action protocols do not apply to small claims actions.

    AIUI even if the court rules against you but rules you can pay by instalments, as long as you meet the plan, it does not affect your credit record.

    But to protect yourself, given your issues, you should get it paid off ASAP and you should certainly get up to date with anything already agreed without delay.
