Hi
The BHS card was originally with GE Money, and was a store card then about 2 years ago GE Money changed the card into a credit card. I didn't ask for this to change, when my card was renewed it appeared as a credit card.
Anyway Santander have bought out the part of GE Money that was concerned with these cards.
I've sent in my first letter to Santander to reclaim PPI on my BHS credit card. Santander have written back stating that they can find no reason to refund my PPI and that it wasn't misold. And that the court case against GE Money in 2005 doesn't apply to my claim as my PPI was taken out before that date.
I'm going to send off my second letter and wondered if you thought it might be taking things a bit far if I was to ask them to detail to me the financial training given to shop floor staff in BHS which enabled them to give me financial advise when I took out the card in the Store. (this was one of the points I was claiming back the PPI on).
Also, does anyone know if the 2005 court case effects my claim, I don't know about pre 2005 but would it effect the payments made after 2005?

Not sure on the 2005 court case issue but sure someone should know this and post up for you.
I would as well send another letter with what you stated, why not?;)
Its your money and you have been out of pocket for it, so write away, good luck.
Am wondering though if they do not resolve this in your favour, then contact the FOS and ask them if they are able to investigate.

hi i am about to do the same & send a claim for 2 stores cards i had with G E captial . would you be really kind & send me the address you used as i cant seem to find it . thanks0

On Companies house search, I found the address for GE Capital if this is the correct one, I understand they have a few groups, so also check any documents you have with the company number just in case:

Evening everyone.
I have also received a 1st reply from Santander. The letter addresses my points, odd because some of the points have not been raised in my letter to them.
They state that because it was required to tick the box for PPI and I have ticked the box for PPI this shows that it was made clear that the policy was optional
Strange how they know it was me that ticked the box.
They go on to say that there was no requirement upon them to record the sales process so they have no way of knowing what took place in April 1997 (but they know it was explained it was optional) :eek: thought I may have been paying this a couple of years following a phone sale so am gobsmacked to know it is from when I took the card out in store.
There is a number to ring the case handler so will do that and see if I can email my response.
Anyway they have referred me to the FLA if I'm not satisfied , why FLA and not FOS? Does anybody know why this is?

Hi there, hope your well.
The reason for the FLA is because the business you are complaining about were not covered or under jurisdiction until Jan 2005, some but not all finance companies were covered by GISC where the FSA taken over in Jan 2005, the FOS are only normally able to investigate complaints if they were protected by these regulators.
However, the FLA can be a right pain...sorry to say.......:o, you could give it a go, but otherwise still ask the FOS if they would consider investigating this for you.
In the worse scenerio, whoever the insurer was to Santander, write to them.
One of mine that was returned to me a few times from the FOS due to this reason, where then many have posted up on here to suggest writing to the insurer/underwriter instead, where I believe were all protected for jurisdiction.
The FOS have finally accepted my case but not to involve the broker but the insurer instead.
You can try first if you want to asking if they are able to take a look at your complaint first, and if they don't write your complaint to the insurer instead to hold them responsible.
You could however, ask the FOS if they could write to the insurer on your behalf if you want to, (if they unable to look at the complaint holding Santander responsible).
