ESA miscalculations(lies)

I have just been turned down for esa after a medical and I requested a copy of the report to be sent to me.After reading the report I am extremely annoyed and disgusted at the things that have been put in there that are untrue and make me out to be a liar,my rheumatologist at the hospital treating me to be a liar and also a occupational health doctor I was sent to by my former employer last month.How can this happen and how should they be allowed to blatantly lie on a medical and still be allowed to continue in their position.I know they are paid a bonus to get people into work but this is ridiculous.

    The Doctor/Nurse you saw is not paid a bonus to get you into work.

    Is it ATOS? If so, if you appeal they get fined. If you win the appeal they dont get paid.
    You may need to go to a tribunal, depends how your appeal letter is I guess.
    Ive been through this myself so I understand how difficult it is.
    You have I think 28 days from decision to appeal, so get the letter sent asap.

    It is ATOS yes sorry if I was mis-informed about whether they get a bonus but if they do't then why do they make up things on the medical form-things which I never even said and they have not contacted my GP or the rheumy.

    Its a calendar month that you have to appeal. Its worked out from the day you are expected to have received the disallowance letter (Think that is 2 days after it is issued).

    I dare say the ATOS Proffesional didnt lie - there simply has to be another explanation.

    Ok maybe they have not lied maybe its just the fact that because she was polish it may have just got 'lost in translation'.

    If you feel that your ATOS medical was carried out unjustly, you have 1 month from the decision date to ask for a review of the decision or appeal it (which will go to an independant tribunal).

    Use Form GL24 if you should wish to appeal and make sure to get it in asap.

    Your ESA will be re-instated at assessment rate (basic) whilst you are appealing their decision.
