My rights to a refund?!

I dont know if i have any rights here but hopefully someone could help.
I bought a pair of boots for my daughter last weekend, she is a size 8 but i bought a size 8.5 as they cost me £89 so she could get a bit more wear from them. She already has a pair of boots in a different style but the same brand in a size 8 and they fit her perfect and the new ones are far to small even though they are a half size bigger. When i went back to the shop they had no bigger sizes. I had spent £130 on a coat and dress in its sister shop next door to go with the boots so i needed red or black patent shoes or boots and they had nothing.
Now it does say on the receipt no refunds just a cedit note will be given.
But she has £89 of my money in her till and i have nothing. I asked if i could use the credit note in the sister clothes store next door and i was told no. She is not getting another delivery until spring so she said i could get something then!! :mad: Keeping in mind this was her outfit for chritmas day!! I have a coat and dress with no shoes for it and im down £89. I am fuming! Is there anything i can do???

    well if you went down the route of the sale of good act you would be claiming they are faulty, they would have to prove otherwise, and my thoughts are that they will prove that they are the same size as all of the other shoes that style (ie not a miss-label or manufacturing error) in which case you have no rights at all

    you should have let them try the shoes on first,


    its worth another shot though

    You are not entitled to a refund unless they are faulty. Many shops will refund for whatever reason, but they have no obligation to. Shoes are always a bit of a nuisance as sizes tend to differ everywhere. Depending on the design of the shoe it can be a lot smaller/bigger than you expect, and I expect that's what happened in this case.

    I would go back to the shop anyway to ask if you can compare the shoes you bought with another identical pair, just in case it is mislabelled. If not, probably best just to be glad you'll get a credit note- as it's better than nothing :confused:

    I've learnt the hard way that it's essential you try before you buy, especially when buying for other people, but in this case I'd chalk it up to experience.

    when you say it is a 'sister' clothes shop next door what exactly do you mean,same family,same chain?have you asked the other shop if they will accept the credit note

    I am intrigued as to how old your daughter is, are we talking about a child or adult size 8?
