Egg - any advice please

I am after advise for my husband please. He recently looked into his Egg card account as he hasn't used his card for over a yr now. Anyway, he noticed that there was payment protection showing at around £20 per mth, he has no recollection of taking this out back in 2000 when he applied for his card. We sent the following to Egg via their secure messaging service last night:

I purchased the above policy from you in February 2000 but now believe that I was mis-sold this policy for the following: This is due to the fact that you have been fined by the FSA for failing to treat your customers fairly when selling Payment Protection Insurance and I do not believe that my policy was sold in my best interests. Unless you can satisfactorily justify to me that the policy was fair and reasonable I am requesting a full refund of all premiums, and subsequent interest on these payments, that I have paid to date. As I believe I have been deprived of this money I also expect 8% statutory interest, the amount a court would award, to be added to each payment made. I look forward to a full and prompt response to this letter and for the matter to be concluded within eight weeks or I shall be contacting the Financial Ombudsman to investigate my complaint.Yours faithfully,

He received the following message back from them this morning:

This policy wasn't sold to you, you took out the cover yourself on your original application.I'm not able to refund any of the premiums paid.I have logged a complaint of dissatisfaction on your behalf, but this complaint is now closed.We'll be happy to send you the copy of the agreement that you've requested, however, all requests for copies of the Credit Card Agreement must be sent in writing to the following address:Data Request TeamTransaction ServicesEggRiverside RoadPride Park DerbyDE99 3GGThere is a charge for this service. Please enclose a cheque for £1 which should be made payable to 'Egg'.If you want to request more than one credit agreement from Egg, these are charged at £1 each, so please adjust the cheque payment accordingly.We'll send this information to you within 12 business days from receipt of your request and cheque payment.Thanks for the message.

I just wondered what we should do next? Send off for the agreement to see what it says? He thinks he applied online and can't remember ever applying for the protection but that's not to say he didn't.Do we need to respond back to Egg via the secure messaging service to tell them what we intend to do? Many thanks for any advice given

    Yes you could get copy of the original agreement. I wonder if you had to opt out of the PPI I am sure Egg used to have that facility on line. So what I am saying is the box would have been pre-ticked to take the PPI and you would have had to cancel the tick. This is now seen as bad practice.

    Yes request they sent you the agreement and enclose a £1 postal order or cheque payment, ask that they send you this by 12 days, and then move your case on to the financial ombudsman service (FOS).

    You can either download and print the complaints form from the FOS site or ring to arrange they send you one, and enclose copies of correspondence you have with the form.

    Many on here have had dealings with EGG, I'm sure the FOS will investigate this for you.

    I would suggest sending the complaint as a letter (recorded delivery) instead of using the online messaging service.

    My girlfriend wrote to egg to claim PPI on her credit card. Listed following mis-selling reasons: Did not know she had cover, use of check boxes, she was a student and wasn't working for four years so claiming would not be possible, and the fact they have been fined by FSA.

    They refunded £970 to her card in less than a week. Good luck.
  • If they are telling you that the complaint is now closed then, regardless of the fact that they have not complied with the rules, you can take them to the Financial Ombudsman Service now.

    Enclose hard copies of the e-mail correspondence and say where the FOS form asks if they have issued a final response say "yes". FOS now reports on firms getting more than 30 complaints in a six month period and, if I remember correctly, Egg did not do very well last time. If they do badly again the FSA is likely to become interested.:beer:
